Terms of Service

By accessing or using Cashoy ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our Service.

Age Requirement: You must be at least 18 years of age to use Cashoy. By using this Service, you represent and warrant that you are of legal age to form a binding contract.

Accurate Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

One Account Per Person: Each user is permitted to maintain only one account. Creating multiple accounts or allowing others to use your account is strictly prohibited.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Ensure that you log out from your account at the end of each session

Account Suspension: We reserve the right to suspend, disable, or terminate any account that violates these Terms of Service, engages in fraudulent activity, or poses a risk to our Platform or other users.

Tracking Links: Cashoy provides you with unique tracking links for affiliate offers from various brands and networks. These links track conversions generated through your promotional activities.

Commission Structure: When someone clicks your tracking link and completes a qualifying action (purchase, sign-up, etc.), you earn a commission. The commission amount varies by offer and is displayed on each offer's details page.

Hold Period: All approved commissions are subject to a 30-day hold period before becoming available for payout. This hold period protects against refunds, chargebacks, and fraudulent activity.

Platform Fee: Cashoy takes a platform fee from the network payouts. The commission amounts displayed to you already reflect this fee structure (what you see is what you earn).

Minimum Payout: A minimum payout threshold of $50.00 USD applies. You can request a payout once your available balance reaches this threshold.

FTC Compliance: You must comply with all applicable Federal Trade Commission (FTC) guidelines and local regulations regarding endorsements and testimonials. This includes clearly and conspicuously disclosing your affiliate relationship when promoting offers.

Prohibited Practices: You must not engage in:

• Spam or unsolicited communications
• Misleading, false, or deceptive claims about products or services
• Trademark infringement or brand misrepresentation
• Fraudulent activity, fake traffic, or click manipulation
• Promotion on prohibited content (adult content, illegal activities, hate speech, etc.)

Brand-Specific Terms: You must comply with each brand's specific terms and conditions, promotion guidelines, and content restrictions. These may be provided on the offer details page or by the advertiser.

Content Standards: All content you create to promote offers must be professional, accurate, and comply with applicable advertising standards and laws.

Earnings Estimates: All earnings displayed in your dashboard are estimates until confirmed by the affiliate network. Networks may reject or reverse conversions based on their validation processes.

Currency Conversion: Commissions may be earned in a currency other than your payout currency. When that happens, we convert the commission to your payout currency at the exchange rate in effect when the conversion is recorded, and the converted amount is what is credited to your balance and paid out. The rate applied includes a small currency conversion fee. Because the rate is locked at the time each conversion is recorded, the credited amount does not change with later exchange-rate movements.

Hold Period: Approved commissions are subject to a 30-day hold period before becoming eligible for payout. This protects against refunds, cancellations, and fraudulent transactions.

Minimum Threshold: The minimum payout threshold is $50.00 USD. This threshold is subject to change with reasonable notice to users.

Payout Methods: Payouts are processed via direct bank transfer to the bank account you provide in your account settings. You are responsible for:

• Providing accurate and complete bank account information
• Ensuring your bank account can receive transfers in the payout currency
• Any fees charged by your bank for receiving transfers
• Updating your bank details if they change

We are not liable for failed, delayed, or misdirected payments resulting from incorrect bank details you provide.

Fraud Protection: We reserve the right to withhold payment if we suspect fraudulent activity, terms violations, or any activity that may harm our Platform, advertisers, or other users. Payments may be withheld pending investigation.

Chargebacks & Reversals: If a conversion results in a chargeback, refund, or reversal, the commission amount will be deducted from your account balance, including from future earnings if necessary.

Free & Pro Tiers: Cashoy offers both free and paid subscription tiers. The Pro subscription ("Cashoy Pro") provides access to additional features including unlimited AI caption regenerations, creative library, advanced analytics, and priority support.

Billing: Pro subscriptions are billed either monthly ($29 USD) or annually ($249 USD) in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Cancellation: You may cancel your Pro subscription at any time through your account settings. Upon cancellation:

• You retain Pro access until the end of your current billing period
• Your account reverts to the free tier after the billing period ends
• No refunds are provided for partial billing periods

Payment Failures: If your payment method fails, we may retry the charge or suspend your Pro access until payment is received. We are not liable for any loss of access due to payment failures.

Price Changes: We reserve the right to change subscription pricing with 30 days notice to existing subscribers. Price changes will take effect at your next billing cycle. Your continued use after a price change constitutes acceptance of the new pricing.

Feature Changes: Pro features may be added, modified, or removed at our discretion. We will provide reasonable notice of material changes to Pro features.

Referral Commissions: You may earn referral commissions by inviting others to join Cashoy using your unique referral link. When someone signs up using your link and earns commissions, you receive 15% of their earnings for 12 months from their registration date.

Referral Terms:

• Referral earnings are subject to the same 30-day hold period as regular commissions
• There is no cap on the number of users you can refer or the referral earnings you can accumulate
• Referral commissions are calculated based on the referred user's promoter earnings, not network payouts

Prohibited Referral Practices:

• Self-referrals (referring yourself or your own alternate accounts)
• Fraudulent referrals using fake accounts or identities
• Incentivizing sign-ups with cash, gifts, or other consideration not approved by Cashoy
• Misleading claims about earnings potential to attract referrals

Violations: Fraudulent referral activity will result in forfeiture of all referral earnings and may result in immediate account termination.

Program Changes: We reserve the right to modify referral commission rates, duration, or terms, or to discontinue the referral program entirely, at any time with reasonable notice.

Cashoy's Rights: Cashoy and its licensors own all rights, title, and interest in and to the Platform, including all software, technology, content, trademarks, logos, and branding. You may not copy, modify, distribute, sell, or lease any part of our Platform without express written permission.

Your Content: You retain all rights to content you create for promotional purposes. However, by using Cashoy, you grant us a non-exclusive, worldwide, royalty-free license to display your username, profile information, and promotional statistics for Platform operation and marketing purposes.

Trademark Usage: You may not use Cashoy's trademarks, logos, or branding without our prior written permission. Any approved use must comply with our brand guidelines.

You agree not to engage in any of the following prohibited activities:

• Fraudulent Conversions: Generating fake conversions, using your own links for personal purchases (unless explicitly allowed), or encouraging others to do so
• Automated Traffic: Using bots, click farms, automated scripts, or any artificial means to generate clicks or conversions
• Misleading Advertising: Making false or misleading claims about products, services, or earnings potential
• Incentivized Clicks: Offering incentives for clicks without proper disclosure or in violation of advertiser terms
• Cookie Stuffing: Manipulating cookies or tracking mechanisms to falsely claim credit for conversions
• Trademark Bidding: Bidding on trademarked terms in paid search unless explicitly permitted by the advertiser
• Email Spam: Sending unsolicited emails or messages containing affiliate links
• Malware/Adware: Distributing malware, adware, or software that manipulates user behavior
• Legal Violations: Violating any applicable laws, regulations, or third-party rights

Voluntary Termination: You may close your account at any time through your account settings or by contacting support. Upon closure, you will forfeit access to pending earnings that have not met the payout threshold.

Termination by Cashoy: We reserve the right to suspend or terminate your account immediately, without prior notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent activity or suspected fraud
• Violation of advertiser terms or guidelines
• Behavior that harms or could harm Cashoy, advertisers, or other users
• Extended periods of inactivity

Effect of Termination: Upon termination:

• Your right to use the Platform immediately ceases
• Pending earnings may be forfeited if termination is due to fraud or terms violations
• Approved earnings that have passed the hold period will be paid out according to our normal schedule
• You must cease all use of Cashoy branding and promotional materials

Survival: Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitation of liability.

"AS IS" Service: The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

No Earnings Guarantee: We make no guarantees regarding earnings, income, or commission amounts. Results vary based on many factors including effort, audience, niche, and market conditions. Past performance does not guarantee future results.

Third-Party Responsibility: We are not responsible for the actions, products, services, or content of third-party advertisers, networks, or brands. Each advertiser is solely responsible for their offers, products, and compliance with applicable laws.

Offer Availability: Offer availability, commission rates, and terms are subject to change without notice. Advertisers may pause, modify, or discontinue offers at any time.

To the maximum extent permitted by applicable law, Cashoy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or earnings
• Loss of data or business opportunities
• Interruption of business
• Cost of substitute services

Maximum Liability: Our total liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the greater of (a) the amount of fees paid by you to Cashoy in the twelve (12) months preceding the claim, or (b) $100 USD.

Jurisdictional Limitations: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Cashoy, its affiliates, officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the Platform
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Your promotional content or activities
• Any fraudulent, illegal, or unauthorized activity conducted through your account

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

We reserve the right to modify or update these Terms of Service at any time. We will notify you of material changes by:

• Sending an email to the address associated with your account
• Posting a notice on our Platform
• Updating the "Last Updated" date at the top of this page

Your continued use of the Platform after any changes indicates your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.

We encourage you to review these Terms periodically to stay informed of any updates.

These Terms of Service shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved exclusively in the courts located in Queensland, Australia, and you consent to the personal jurisdiction of such courts.
